About Intervention Orders

Intervention Orders (IVOs), also known as Apprehended Violence Orders (AVOs), Family Violence Intervention Orders (FVIO) and Personal Safety Intervention Orders (PSIO) are a type of Order made by the Magistrate and/or a Registrar by the Court that restricts the actions of a person to protect another person.

Understanding Intervention Orders

So what exactly is an Intervention Order?
An intervention order is a civil order of the Magistrate’s Court which prohibits an individual from doing certain acts. There are two types in Victoria depending on the relationship between the Affected Person (the person who needs protection, also known as a ‘Protected Person’) and the Respondent (the person from whom the Affected Person requires protection). If the Affected Person and the Respondent are family members, a married couple, a de-facto couple, or have an intimate relationship, then a Family Violence Intervention Order will be the relevant Intervention Order.
If the Affected Person and the Respondent do not fit into the criteria above, then a Personal Safety Intervention Order will be the relevant order.
Both type of Court Orders are governed by different legislation, but share many similarities. Firstly, they are both dealt with by the Magistrate’s Court of Victoria. Secondly, they both involve at least one Affected Person, and at least one Respondent.

The most obvious difference is the names, both of the Order itself, and the names used to describe the individuals affected by the court order
In a Family Violence Intervention Order, the Affect Person is an ‘Affected Family Member’. The Court Order will also refer to family violence, rather than ‘prohibited behaviour’. Further, a Family Violence Intervention Order is governed by the Family Violence Protection Act 2008, whereas Personal Safety Intervention Orders are governed by the Personal Safety Intervention Order Act 2010.
